The stament starts "It may be laid" instead of "It must be laid". Note also Washington's later comment: "It is not for me to decide positively, whether it will be ultimately most interesting to the happiness and safety of the United States, to form this Class of Soldiers into a kind of Continental Militia …" Probably best to read the entire document (supposedly a 1783 letter to Alexander Hamilton, http://en.wikiquote.org/wiki/Citizenship, while he was still Commander-in-Chief of the Continental Army, and not yet President).
